PYRONOVA group

Dear reader,

PYRONOVA group companies have prepared this document for you to meet  the new legislation on the protection of your personal data and to fulfil their information duty.

The PYRONOVA Group, same as in other areas, as well as in the area of personal data protection, aims to maximize the security of your personal data and to guarantee transparency when dealing with them.

  1. Why did we make this document?

New legislation on the protection of personal data entered into force, which requires us to inform you about what we do with your data and to provide you with further relevant information.

This is Regulation 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data, also known as GDPR. In the text we will continue to use the term “Regulation“.

  1. Who we are ?

We are PYRONOVA group companies whose main business is fire protection. PYRONOVA Group includes the following companies:

  • PYRONOVA s. r. o., with registered office at Landererova 8, 811 09 Bratislava, Slovak Republic
  •  PYRONOVA IS, s.r.o., with registered office at Studniční 248/18, 617 00 Brno, Czech Republic
  •  PYRONOVA IS SRL, with its registered office at Calea Turzii 192, 400495 Cluj-Napoca, Romania
  •  PYRONOVA IS Hungária Kft., with its registered office at Építők útja 2 – 4, 2040 Budaörs, Hungary
  •  PYRONOVA IS POLSKA sp. z o.o., with its registered office at Pulawska 599B, 02-885 Warsaw, Poland

These companies are the Controllers within the meaning of the Regulation. The Controller is any person who has decided to carry out an activity including, but not limited to, the processing of personal data, identifying the purposes and means of processing it.

Therefore, if you provided personal data (name, surname, etc.) to one of these companies, for example, to conclude a purchase contract, this company has the status of the Controller with respect to you and you may exercise all of your rights as described below and, if necessary, contact the company about the information.

  1. What are our contact details?

  1. What personal data do we process?

In the first place, we will let you know what the personal data is. Personal data is any information related  to a physical person that can be directly or indirectly identified. Personal data include, for example, the name, surname, type and address of the residence, date of birth, birth number, email, telephone number, signature, but also location information, online identifier, photo, voice recording, etc. Any information that is specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that physical person is considered to be personal data.

Each of the companies in the PYRONOVA Group processes personal data necessary for the performance of its business activities and related activities, fulfilment of its legal and contractual obligations, pursuing its legitimate interests.

In particular, the following categories of personal data are processed:

  • Basic identification information: title, first name, last name, family name, date of birth, birth number, home address, identity card number, photo, audio-visual record, citizenship, nationality, signature, employer and job position, place of work and company ID if self employed.
  •  Contact details: phone number, e-mail address, fax, contact address.
  •  Transaction data: bank name, bank account number.
  •  Socio-demographic data: age, gender, marital status, education, employment.

Other personal data may be processed, for example, if you are a job-seeker, we also process your other personal data within the scope of your CV or motivation letter.

Each PYRONOVA group company,  in every processing of personal data is governed by the need to know principle of data minimization – the adequacy of the extent of the data with regard to the purpose of the processing.

You can request a list of personal data processed by the PYRONOVA group company at any time using the above mentioned contact information.

  1. Where do we collect your personal data from?

Your personal data is collected by the PYRONOVA group companies from the following sources:

  • directly from you when signing the contract and performing the contract or obtaining your consent with the processing of personal data
  • from other people, if you give your consent (e.g. from a family member)
  • from proceedings before public authorities
  • from publicly available registers, lists and records
  1. For what purpose do we process your personal data?

PYRONOVA Group companies maintain the same procedures for the processing of your personal data governed by the internal policies applicable to the entire PYRONOVA group. For this reason, the following purposes for processing of your personal data by entities are the same for all PYRONOVA group companies.

The exception is the processing of personal data by a camera system operated by PYRONOVA s. r. o. in Trnava, Slovakia, provided for at the end of this section, which constitutes a special way of processing the personal data by this company.

Business partner

If you are a business partner or an employee of the business partner (such as clients, suppliers, service providers etc.) of the PYRONOVA group company, the purpose of processing your personal data is a regular keeping of records in our internal systems and the use of basic contact details and your job function for communication needs and workflow and fulfilment obligations arising out of existing contractual relationships and legal obligations, or the performance of activities related to pre-contractual relationships. The legal basis for this processing is the Article 6 (1) b) of the Regulation. The legal basis may also be to pursue the legitimate interest related to the protection of the rights and the enforcement of the claims of the PYRONOVA group, Article 6 (1) f) Regulations.

The purpose of processing your personal data is also to manage relationships with business partners, invitations to social events, marketing and communication, product development, services and business activities, communication with the PYRONOVA group company, providing feedback. The legal basis for this processing is to pursue the legitimate interest of the PYRONOVA Group in maintaining good relations with business partners and building the reputation and reputation of the PYRONOVA group, i. article 6 par. 1 f) of the Regulation.

In the event that there is a financial settlement between us on the basis of existing legal relationships, we process your personal data for the purpose of issuing an accounting and tax document in accordance with local legislation governing accounting issues and accounting or tax documents. The legal basis for such processing is the fulfilment of the legal obligation in accordance with the provisions of Article 6 1) (c) of the regulation and performance of the contract in accordance with Article 6 (1) b) of the regulation.

If you are a party to any contract or agreement with PYRONOVA, your personal data will be processed to the extent necessary for the preparation, negotiation, amendment, and record-keeping of the contract-legal relationships. This data shall be processed pursuant to Article 6 (1) b) Regulations.

In case you are our long-term business partner, we also process your personal data for the purpose of maintaining, recording and administering data on external business partners, including data about their employees as contact persons. The legal basis for such processing may be the performance of the contract (e.g. the framework contract) and therefore Article 6 (1) b) Regulations as well as legitimate interests in the form of  creation of a list of business partners in order to maintain good relations with business partners and facilitate the internal processes of PYRONOVA.

Job seeker

In case you are a job seeker in a PYRONOVA group company, the purpose of processing your personal data is to assess your assumptions for the performance of the proposed job position and, if necessary, to enter into the employment relationship with you. The legal basis for this processing is your free and unambiguous consent under Article 6 (1) (a) Regulations.

If you have not succeeded in securing a job in a PYRONOVA group company you have been trying to get, but this PYRONOVA group company would like to address you in the future with a job offer, the purpose of processing your personal data by this PYRONOVA group company is to keep records of suitable potential job seekers. The legal basis for such processing is your free and unambiguous consent with the processing of your personal data under Article 6 (1) (a) Regulations.

If you are a job seeker in a PYRONOVA group company and your personal data was provided to the company by another person (e.g. your friend, family member, friend) the legal basis for the processing of your personal data is your written consent with the processing of your personal data pursuant to Article 6 (1) (a) Regulations. In this case, if you don´t give consent or authority to enable such provision, your personal data from a third party will not be taken collected by the PYRONOVA Group company and further processed. In the case of accidentally obtained personal data that the company of the PYRONOVA Group has not requested for any purpose, it will be immediately destroyed.

Partner

In the case that you are a partner or an employee of a partner of a PYRONOVA group company, the purpose of processing of your personal data by this company is to maintain the list of partners, the registration of your personal data in the public register, the preparation and storage of corporate documents, the fulfilment of the rights and obligations arising from the relationship between the partner and the company and the legal obligations, or compliance with the obligations and defence of rights in relation to various inspections and proceedings by a public authority (e.g. a tax authority). The legal basis for the processing of your personal data is Article 6 (1) (b) and c) Regulations.

Statutory body

If you are the statutory body of the PYRONOVA group company, the purpose of processing of your personal data by this company is to register your personal data in the public register, to prepare and keep the corporate documents, to comply with the rights and obligations of the statutory body and company and legal obligations, complliance with the obligations and defence of rights during inspections and proceedings by a public authority (e.g. a tax authority). The legal basis for the processing of your personal data is Article 6 (1) (b) and c) Regulations.

Attendance at social events

If you have signed up for a social event organized by a PYRONOVA group company, or the entire PYRONOVA group, the PYRONOVA group company that you have provided your personal data to shall process the same for the purpose of organizing and management of your attendance at the organized social event. The legal basis for the processing of your personal data is your consent under the provisions of Article 6 (1) (a) Regulations. The consent may be given in writing or by active action in the form of voluntary photographing/recording. Photographs and videos may be produced at social events for the purposes of marketing of PYRONOVA Group or a PYRONOVA Group company, and you express your consent to such processing of personal data by being present within clearly labelled space being recorded by a marked photographer / cameraman. If you disagree, you stay out the area being recorded. You have the right to object effectively at any time against rendering of your person’s image / video / audio recording.

Social Network User

On Social Networks (facebook, instragram, youtube, linkedIn, and others), a PYRONOVA or PYRONOVA group company profile is created, where personal data of registered users who use our professionally managed profiles are also processed. This processing is governed by separate privacy policies that are transparently published at our social networking profiles. The legal basis for this processing may be your consent (Article 6 (1) (a) of the Regulation) confirmed by a clear action – interaction within our profile (e.g. “Like” or “Sharing” etc.) or other active action related to the use of our social networking profile (e.g. commenting on posts, engaging in consumer competition by sending a photo using internal mailing service operated by the social network, etc.)

Debtor

If you are a debtor, an employee of a debtor to the PYRONOVA group company, your personal data is processed by this company for the purpose of out-of-court recovery of its due claim. The legal basis for such processing is the exercise of the right of the PYRONOVA group company against your person resulting from the performance agreed between you and the PYRONOVA group company within the framework of a contractual relationship, Article 6 (1) (b) of the Regulation, while processing is necessary for the purposes of legitimate interests in the form of protection and enforcement of the rights of the PYRONOVA group of companies, i.e. Article 6 (1) f) Regulations.

Party to a proceeding

If you are a party to a proceeding or an employee of a party involved in a lawsuit against a PYRONOVA group company or in a proceeding by a PYRONOVA group company against such party, your personal data is processed by that company for the purpose of recording its legal agenda in conducting various court proceedings, arbitration proceedings, enforcement proceedings and administrative proceedings. The legal basis for such processing is the exercise of the PYRONOVA group company’s right against your person resulting from the performance agreed between you and the PYRONOVA Group company within the contractual relationship, i.e. Article 6 (1) (b) of the Regulation and at the same time the processing is necessary for the purposes of legitimate interests in the form of protection and enforcement of the rights of the PYRONOVA group company, i.e.  Article 6 (1) (f) of the Regulation.

Post sender/recipient

If you are an employee of an addressee (recipient)´s to whom a company from the PYRONOVA group sends the correspondence or the sender or an employee of a sender from whom the PYRONOVA group company receives correspondence (either in paper form or via electronic mailbox), your data is processed for postal registration purposes in accordance with local archive, registry, and e-mail regulations. The legal basis for such processing is the fulfilment of the statutory duty of the company, i.e.  Article 6 (1) (c) of the Regulation However, the legal basis for such processing may also be the performance of the contract, i.e.  Article 6 (1) (b) of the Regulation, provided that the correspondence is related to a business case as well as legitimate interest in the form of recording the correspondence for the purposes of potential protection of rights or enforcement of claims of a PYRONOVA group company, i.e.  Article 6 (1) (f) of the Regulation.

Person at a construction site / building

If you are a physical person present at a construction site, you are required to comply with OSH regulations regardless of whether or not you are an employee, otherwise there is no reason for you to be present at the site. During the inspection of compliance with OSH at construction sites, PYRONOVA group company produces photographic documentation, which serves and is further processed for the protection of the rights and the protected interests of the Company. When making photographic documentation it is made sure that the rights and legitimate interests of the subject concerned are not violated in any way. The legal basis for such processing is the fulfilment of the statutory duty of the company, i.e. Article 6 (1) c) Regulations in the field of OSH and Article 6 (1) f) – the legitimate interests of the Company in the demonstration and the fulfilment of the obligations in the field of OSH and ensuring the compliance at the construction sites.

A PYRONOVA group company processes the personal data and documents of a physical person present at a building site and carrying out work or services for it through a provider of these works and services to check the compliance with the prohibition of illegal employment on the basis of local legislation. The legal basis for such processing is the fulfilment of the statutory duty of the company, i.e. Article 6 (1) c) Regulations.

Reporting anti-social activity (whistle blower)

If you are reporting any anti-social activities, the purpose of processing of your personal data by a PYRONOVA group company is to comply with the legal obligations under the local law governing the whistleblowing. The legal basis for the processing of your personal data is the provision of Article 6 (1) c) Regulations.

Sponsorship applicant

If you are a sponsorship applicant, or an applicant´s employee, the purpose of processing of your personal data by the PYRONOVA group company is to assess the sponsorship request and, possibly, to conclude a sponsorship contract. The legal basis is your consent with the processing of your personal data, i.e. Article 6 (1) a) Regulations, or, in the case of the conclusion of the aforementioned contract, the legal basis for the processing of your personal data is the Article 6 (1) b) Regulations.

Website visitor

If you are a visitor to www.pyronova.com and contact a PYRONOVA group company through a contact form or any other contact information available at this site, your personal data may be processed by this company for the purposes of contacting or otherwise for purposes specified in this policy if they are related (for example, if you are a business partner and contact a PYRONOVA group company regarding a business case). The basis for processing of your personal data is your consent. The consent may be given by sending a message via the contact form by checking the checkbox – “I agree with the processing of the personal data in the contact form“. In the event that a PYRONOVA group company is contacted using other contact details (e-mail address, telephone number and fax) published at our www.pyronova.com website, you give consent with the processing of your personal data by sending an e-mail or by another way of contacting (that is, by your active action). The legal basis for the processing of your personal data is Article 6 (1) a) Regulations (that is, your consent).

Another person

In the event that you do not fall under any of the above categories of persons, the PYRONOVA group company processes your personal data in order to process your message, query, response or another action. The legal basis for the processing of personal data is, in this case, dependent on the content of your report, the query, the response to another action, and your consent (Article 6 (1) (a) of the Regulation) or the legitimate interests of a PYRONOVA group company (Article 6 (1) (c) of the Regulation) or another legal basis under Article 6 of the Regulation.

Each PYRONOVA group company will gladly inform you on the legal basis for the processing of your personal data.

Visiting at the premises of PYRONOVA s.r.o. in Trnava in the Slovak Republic

If you are a visitor to PYRONOVA s.r.o. premises at the address of Ivana Krasku 31 in Trnava, Slovakia, monitored by the camera system, the purpose of processing your personal data is to protect the rights and the legally protected interests of the PYRONOVA group company in the form of protection of the property of PYRONOVA s.r.o. and property of others, health protection, security and prevention of crime and offences in the monitored area and their detection. The legal basis for this processing of your personal data is Article 6 (1) f) Regulations.

In the future, premises of other PYRONOVA group companies may also be monitored by camera systems.

  1. Who are potential recipients of your personal data?

Your personal data may be provided to the following groups of recipients by the PYRONOVA group company:

  • other companies in the PYRONOVA group
  •  business partners who provide services to a PYRONOVA group company or to the PYRONOVA group, in relation to which your personal data may be processed. This includes: suppliers of goods, works and services necessary for the performance of business activities of PYRONOVA Group, personal agencies, marketing agencies, advertising agencies, companies providing services of registration and archiving, companies providing private security services, external companies providing services for development and support of internal systems, software and IT companies, cloud services or web hosting, GPS monitoring solutions suppliers for our service vehicles, suppliers providing assistant administrative services, contractors delivering professional photos / videos, banks, insurance companies, insurers, lawyers, accountants and tax advisers, auditors. You can get more information about our current intermediaries at any time on request.
  •  a business partner provided services or goods by a PYRONOVA group company that may process your personal data (e.g., developers, property owners, and others)
  •  public authorities such as courts, state administration and self-government bodies, public bodies, law enforcement agencies, tax authorities, customs authorities, financial authorities, notaries, receivership authorities, insurance companies, pension companies, control and supervisory bodies; to the extent necessary for the fulfilment of the obligations under the law, or in the event of the performance of the legal authority of those authorities,
  •  banks, insurance companies, postal service providers
  •  postal delivery service provider, legal service provider, courts, arbitration tribunals, receivership authorities in the event of the execution or defence of rights and claims of the PYRONOVA group company against you or another person.

As we take the protection of your personal data very seriously, we assure you that your personal data will not be made available to the entities if it is unnecessary or pointless.

  1. Are you required to provide your personal data?

If the legal basis for the processing of your personal data is the compliance on the part of the PYRONOVA Group company with a legal obligation and you refuse to provide your personal data, it may result in losses, for example losses that may be claimed from you (for example, if a penalty was levied as a direct result of the failure to comply with the obligation). In such a case, the provision of your personal data is a legal requirement and you are required to provide it.

If the legal basis for the processing of your personal data is to enter into or perform a contractual relationship with a PYRONOVA group company and you refuse to provide your personal data, it will not be possible to enter into a contractual relationship with a PYRONOVA group company. However, the provision of personal data on your part is voluntary.

If the legal basis in the processing of your personal data is a legitimate interest of the PYRONOVA Group company in accordance with Article 6 (1) f), you are obliged to tolerate this processing, but you have the right to object.

  1. How can you revoke your consent if your personal data processing is based on it?

If the processing of your personal data is based on the consent granted to a PYRONOVA Group company, you may at any time withdraw this consent by delivering a notification to the company, to the contact details listed above. The notice must include the withdrawal of the consent.

Revocation of the consent with the processing of personal data is without prejudice to the lawfulness of the processing of personal data made before the appeal.

However, by withdrawing your consent to process your personal data, the processing of your personal data processed by the PYRONOVA group company on another legal basis is not terminated.

  1. What are your other rights in relation to personal data?

First of all, you have the right to receive clear, transparent and comprehensible information about how we use your personal data and what are you rights.

You can ask us:

  • to provide a copy of your personal data and other information (e.g., for what reason we process it, who is their recipient, the time of storage, and the purpose of the processing etc.)
  •  to correct your personal data
  •  to delete your personal data
  •  to limit the processing of your personal data

You can also:

  • object against the processing of your personal data
  •  request the transfer of your personal data
  •  file a complaint with the relevant data protection authorities in a Member State of the European Economic Area (EEA) where you live or work or where there may be a potential breach of the privacy laws
  •  the right not to be subject to a decision that is based solely on automated processing, including profiling, and which has legal effects that affect you or have similar significant effect on you

These rights are further specified in Articles 15 to 22 of the Regulation. You can contact us at any time to get acquainted with them.

You can at any time apply any of these rights against the PYRONOVA group company by delivering the notice to the contact details listed above. The notification procedure is governed by the internal guidelines of the PYRONOVA Group.

  1. How long do we keep your personal data?

The retention period of your personal data varies depending on the reason why the personal data is processed:

  • When personal data is processed to comply with a statutory obligation – for the time required by the applicable law,
  •  if your personal data is processed in relation to contract performance – for the duration of contract performance (including pre-contractual negotiations) and for as long as the rights and claims of a contract or related to the contract can be exercised, evidenced or defended – but not more than 10 years after the performance of the contract, or any other way of terminating the contract,
  •  if personal data are processed due to legitimate interests pursued by a PYRONOVA group company or a third party for the duration of the relevant legitimate interest and for the period during which it is possible to exercise, demonstrate or defend the rights and claims of legitimate interest or related to the legitimate interest,
  •  If personal data is processed on the basis of a consent – for the period for which the consent has been granted or until the withdrawal of the consent,
  •  Recording from the camera system for a period of one year from its recording.

Upon the expiration of these periods, each PYRONOVA group company is authorized to further process personal data only for compatible purposes or, if legally required.

  1. Where do we transfer your personal data?

International transfer of your personal data to third countries outside the European Economic Area (EU, Iceland, Norway, and Liechtenstein) is not intended.

  1. How do we process your personal data?

We process your personal data in electronic form on our server and database stored on a PC or in paper form.

No PYRONOVA group company exercises any processing operations that would lead to the adoption of a decision with a legal effect or other significant influence on your person that would be based on the automated processing of your personal data. PYRONOVA group companies also do not use profiling when processing personal data.

  1. How do we protect your personal data?

The security of your personal data is of prime importance to us. In order to protect your personal data, we have taken the necessary technical and organizational measures.

  1. Not satisfied?

If you are not satisfied with how your PYRONOVA group company processes your personal data, you can contact it at any time using the contact details listed above in this policy.

  1. Since when are these principles applicable and how can they be changed?

These PYRONOVA General Privacy Policies enter into force on 25.05.2018. We reserve the right to change these policies if the processing of personal data changes. You will be informed about each change via our www.pyronova.com and mail.
